MAXXAM.ai respects your privacy and is committed to protecting your personal information. This policy covers our websites, applications, AI automation services, and communication channels including SMS and email. By using our services, you consent to the terms of this policy.
We process SMS content and metadata to deliver messages, provide analytics, prevent abuse, and troubleshoot. Logs are retained for a commercially reasonable period for billing, support, and compliance purposes.
Users are responsible for obtaining legal consent before sending SMS. Marketing SMS recipients can opt out via message instructions or by contacting us. We do not sell SMS phone numbers.
We process email content, subject lines, and metadata for delivery and analytics. Logs are retained for a commercially reasonable period for security and legal obligations.
You can unsubscribe from marketing emails at any time. Transactional emails will continue. We do not sell email addresses.
Depending on jurisdiction, bases for processing include: contract performance, legitimate interests, consent, and legal obligations.
Some customers process Protected Health Information. HIPAA does not create a special "AI privacy rule," but AI tools using PHI fall under existing HIPAA rules.
When a Business Associate Agreement (BAA) is signed, we act as a Business Associate handling PHI in accordance with HIPAA's Privacy and Security Rules.
AI tools are configured for PHI only in designated HIPAA-eligible environments covered by an active BAA. PHI must not enter non-HIPAA services or analytics.
Without an executed BAA, users must not store, process, or transmit PHI via the Services. Unauthorized use occurs at user risk and violates this policy.
We do not sell personal information. Information may be shared with:
Personal data is retained as long as necessary to provide and maintain services, comply with legal and contractual requirements, resolve disputes, and support billing, security, and auditing. Data may be anonymized or aggregated for analytics and business purposes.
We implement reasonable administrative, technical, and physical safeguards aligned with industry practices — including encryption, access controls, logging, and security reviews. However, absolute security cannot be guaranteed.
Information may be stored and processed outside your country. Where required, appropriate safeguards (such as contractual clauses) are used for cross-border transfers.
Depending on your jurisdiction, you may have rights to access, correct, delete, restrict, or port your personal information, and to withdraw consent. Contact us to exercise these rights. For business customer accounts, requests may be directed to that customer.
The Services are not directed to children under 16. We do not knowingly collect children's personal information and will delete it if discovered.
The Services may link to or integrate with third-party websites. Their privacy practices are separate — review those policies before sharing information.
We may update this policy periodically. Material changes will update the "Last updated" date and may include additional notice via email or in-app. Continued use of the Services signifies acceptance of changes.

MAXXAM.ai provides AI-powered automation solutions for small to medium-sized businesses, including:
Feature availability depends on your subscription plan and service agreement.
You must be at least 18 years old and capable of forming binding contracts.
You must provide accurate information, maintain security of passwords, notify us of unauthorized access, and accept responsibility for account activities.
Representatives registering on behalf of an organization warrant they have authority to bind that entity.
Services are for lawful business automation purposes only.
You may not use services for illegal purposes, unauthorized system access, reverse engineering, malware transmission, harassment, impersonation, unauthorized data collection, generating defamatory content, or manipulating AI algorithms.
You ensure AI-generated content complies with applicable laws and does not infringe intellectual property or privacy rights.
AI may produce errors and requires human oversight. Accuracy is not guaranteed.
Aggregated, anonymized usage data may improve AI models. Confidential business data will not train models accessible to other clients without explicit consent. You retain ownership of your data.
When AI makes significant automated decisions, you must inform affected individuals, provide human review mechanisms, ensure legal compliance, and implement bias safeguards.
You acknowledge AI interaction and we commit to identifying AI-generated content where applicable.
Services are subscription-based with various pricing tiers.
Fees are billed in advance monthly or annually. Payment is immediate and non-refundable except as stated. Failed payments trigger 7-day collection attempts before account suspension.
Subscriptions auto-renew unless cancelled 48 hours before renewal. Renewals use current pricing with 30 days' notice of changes.
We reserve pricing modification rights with 30 days' notice, effective on subsequent renewals.
New subscribers receive full refunds within 14 days. Renewals and custom services have different refund terms. Requests go to support@maxxam.ai.
All content, software, algorithms, AI models, and designs are MAXXAM.ai property, protected by applicable law. Copying or distributing without permission is prohibited.
You retain ownership of your uploaded data and content while granting us a limited, non-exclusive worldwide license to use, store, process, and display your content solely to provide the services.
AI-generated output based on your inputs is work product owned by you, subject to our underlying intellectual property rights and applicable law.
We may use your feedback without compensation or obligation.
Data practices are governed by our Privacy Policy, incorporated herein by reference.
We implement encryption, access controls, security audits, incident response, and secure development practices.
You are responsible for maintaining account security, ensuring proper authorization for data processing, complying with data protection laws, and obtaining necessary individual consents.
Services integrate with third-party platforms (CRM systems, communication platforms, payment processors). Third-party use is subject to their respective terms. We are not responsible for third-party practices.
While we strive for reliability, we do not guarantee uninterrupted, error-free operation. Downtime may occur for maintenance or beyond our control.
We reserve the right to modify, suspend, or discontinue services with reasonable notice of material changes.
We are not liable for interruptions from causes outside our control, including technical failures or third-party disruptions.
Services are provided "as is" and "as available" without warranties of any kind, express or implied.
We do not warrant AI accuracy, service reliability, error correction, uninterrupted operation, or result accuracy.
Services do not provide legal, financial, or medical advice. AI content should not be relied upon as professional advice without independent verification.
Our liability is limited to amounts paid in the preceding 12 months or $100, whichever is greater.
We are not liable for indirect, incidental, special, consequential, or punitive damages including profit loss, data loss, or reputational harm, even if advised of the possibility of such damages.
In jurisdictions that prohibit exclusions, liability is limited to the maximum extent permitted by law.
You agree to indemnify MAXXAM.ai and its affiliates from claims, liabilities, damages, and expenses arising from your misuse of the services, violation of these terms, infringement of third-party rights, submitted content, AI implementation decisions, or warranty breaches.
These Terms remain effective during your use of services or maintenance of an account.
You may terminate through account settings, by contacting support, or via written notice. Prepaid fees are not refunded unless otherwise specified.
We may immediately suspend access for term breaches, prolonged inactivity, legal requirements, security risks, or fraudulent activity.
Access ceases immediately upon termination. We may delete accounts and data per retention policies. You remain liable for accrued fees. Intellectual property and dispute resolution provisions survive termination.
You may export your data within 30 days of termination. After this period, deletion proceeds per our retention policies.
Before formal proceedings, contact legal@maxxam.ai for 30-day good faith negotiations.
Unresolved disputes proceed to binding arbitration under American Arbitration Association Commercial Rules, conducted in Atlanta, Georgia or a mutually agreed location. Arbitrator decisions are final.
All proceedings occur individually — not in class or consolidated actions.
Either party may seek injunctive relief for protection of intellectual property or confidential information.
You may bring qualifying actions in small claims court.
These Terms are governed by Georgia state law. You consent to the exclusive jurisdiction of Fulton County, Georgia state and federal courts for non-arbitrated disputes.
